Attempted murder, robbery charges dismissed after $600K compensation

The indictable charges of attempted murder and robbery under arms brought against 19-year-old St Lucian national Condoleezza Henry and her Guyanese co-accused, Kristoff Nicholas, were withdrawn and dismissed.

 

This followed a financial settlement reached with the victim.

 

The decision was made when the matter was called before Acting Chief Magistrate Faith McGusty at the Georgetown Magistrates’ Courts.

 

The court was informed that both accused had complied with the agreed terms of compensation, with each family paying $300,000 to the virtual complainant, amounting to a total of $600,000.

 

In light of the settlement, the prosecution withdrew the indictable charges, which were subsequently dismissed by the court.

 

However, Henry and Nicholas remain before the court on several related charges stemming from the same incident.

 

Henry is now charged with possession of a firearm without a licence and possession of ammunition without a licence.

 

Nicholas, meanwhile, faces three counts: possession of a firearm without a licence, possession of ammunition without a licence, and escape from lawful custody.

 

Following submissions from defence attorneys seeking a review of the bail previously set on the remaining matters, Acting Chief Magistrate McGusty granted bail in the sum of $75,000 on each charge.

 

As a result, Henry was placed on a total of $150,000 bail, while Nicholas was granted bail totalling $225,000. Both matters were adjourned to March 4 for continuation.

 

The charges arise out of a June 20 armed robbery during which 69-year-old operations manager Claudius Fraser was shot in the chest.

 

The court had earlier been told that although Fraser was discharged from hospital, the bullet remains lodged in his chest and surgical intervention is still required.

 

During earlier hearings, counsel for the accused disclosed that negotiations were ongoing with the victim.

 

Acting Chief Magistrate McGusty had emphasised at the time that any settlement could only affect the indictable offences and would not extend to firearm-related charges or the charge of escape from lawful custody.

 

Fraser later indicated his willingness to accept compensation of $300,000 from each accused, which was paid prior to their most recent court  hearing.

 

Henry and Nicholas had initially been denied bail due to the gravity of the allegations and concerns relating to public safety.

 

With the removal of the attempted murder and armed robbery charges, the court proceeded to consider bail on the remaining offences.
