Teacher serving 3 years for sexually assaulting student wants conviction quashed

Popular private school teacher Mohammed Wazir Khan, who was sentenced to three years in jail for sexually assaulting one of his underage students is now asking the Court of Appeal to overturn his conviction. Following a trial last month, Magistrate Leron Daly found Mohammed guilty of the crime. The Magistrate sentenced him to three years’ imprisonment. The convict was also ordered to pay a fine of $1 million.

The offence was committed on March 09, 2019 on a girl below the age of 16. According to the facts, Khan braced his penis on the girl’s vagina. He also squeezed her breast and butt. In the meantime, Todd has moved to the High Court seeking bail for Khan pending the hearing of the appeal. That matter comes up for hearing this Friday, December 18, 2020.At the Court of Appeal, Khan, through his lawyer Dexter Todd, is arguing that his conviction cannot be upheld having regard to the quality of evidence led at his trial.

 

Todd contends that Magistrate Daly showed unconstrained human emotions with the victim’s evidence which created an unfair trial for his client. According to the lawyer, “The learned Magistrate made an error of law when she considered that there was a “strong suspicion” that Khan may well in fact committed the offence. This suspicion could not justify upholding a conviction in all the circumstances of the present case.”

 

Also, Todd is asking the Court of Appeal to fix an early date for hearing the appeal.
