Court grants short adjournment for state to complete disclosure in Mohamed’s firearm case

Magistrate Faith McGusty has granted a short adjournment to allow prosecution ranks to complete processing evidence following additional legal advice in the high-profile firearm and obstruction of justice case involving Opposition Leader Azruddin Mohamed and two co-defendants.

The matter returned to the Georgetown Magistrates’ Court for full disclosure of state evidence. During the hearing, the state prosecutor indicated that while physical statements, crime scene photographs, and four discs were ready for hand-over, further advice received required additional processing by investigating ranks.

“Today is fixed for a disclosure. However, I wish to report to this Honourable Court that some further advice that have been given to clear up certain points,” the state counsel submitted. “So my respectful application is for a short date to do further disclosure if necessary after those advice that would have been granted on 4th.”

The prosecutor confirmed retaining the case file, explaining, “Given that advice has to be sought and advice having been sought for the investigation… The advice was granted, but it’s just for the ranks to complete. I did not release the file because I have it in my possession.”

Defence Attorney Siand Dhurjon, appearing alongside Senior Counsel Roysdale Forde and Damien DaSilva, immediately raised concerns regarding the undisclosed evidence.

“May we inquire, Madam, as to specifically what is the nature of the outstanding materials?” Dhurjon questioned. “Because this matter is of some concern. There is a related matter for which the defendant was charged last Friday, for which he was remanded. This has to do with Mr. Mohammed having received pertinent footage in this matter, an allegation.”

The state counsel responded that core items intended for trial would be turned over within the scheduled timeline. “Madam, as it is, disclosure, as I would have indicated, as it relates to all the dates pertaining in this matter that the prosecution intends to use, including the very dates, would have been disclosed today,” the prosecutor stated, maintaining that remaining elements would be disclosed on the return date.

The charges arise from an incident during the late hours of October 12 into the early morning of October 13, 2026, in Kitty, Georgetown. Mohamed, Mario Mohamed, and Eugene Thorne are jointly charged with unlawful possession of a .32 Taurus pistol, unlawful possession of matching live ammunition, and wilfully attempting to obstruct the course of justice by discharging a firearm in the vicinity of the home of Special Branch head Prem Narine. Narine is a key witness in ongoing extradition proceedings involving Mohamed. All three accused have pleaded not guilty.

The defendants were previously placed on $750,000 bail each following opposition from Deputy Director of Public Prosecutions Diana O’Brien.

Defence attorneys maintain that their clients were unarmed and were documenting police activity outside Narine’s residence. The defence contends that after five to seven gunshots were fired at their vehicle, police intercepted them near Sandy Babb Street and Vlissengen Road. Lawyers for the accused highlighted that an initial roadside search turned up no illegal items, questioning the validity of the firearm allegedly recovered later inside the Kitty Police Station compound.

The defence team has requested full disclosure of government CCTV footage covering Sandy Babb Street, Vlissengen Road, Barr Street, and Thomas Street to establish the timeline of events.

Under their current bail conditions, Mohamed, Mario Mohamed, and Thorne must surrender their travel documents, report weekly to police, and refrain from entering the designated portion of Barr Street or contacting prosecution witnesses.

Magistrate McGusty adjourned the matter to November 27 at 9:30 a.m. for further disclosure.
