Seeram’s legal team fights remand after domestic abuse conviction

A high court challenge on Friday evening stood between former Region Four Chairman and National Director of the Border Patrol Unit, Daniel Seeram, and a month behind bars, following his conviction for assault causing actual bodily harm against his ex-wife, Farzana Hamid.

 

Handing down her decision at the Sparendaam Magistrate’s Court, Magistrate Abigail Gibbs found Seeram guilty on the charge, which had been converted for summary trial under the Administration of Justice Act, and ordered him remanded to prison pending sentencing, resulting in a flurry of emergency legal maneuvers to secure his temporary release.

 

The court heard that the violent altercation unfolded in the early hours of September 11, 2023, at a Cummings Lodge apartment shared by the former couple. Hamid testified that she woke to intense head pain as Seeram struck her following an evening out. Her attempts to film the assault on her mobile phone were cut short when Seeram snatched the device, smashed it against the wall, threw it into the toilet, and continued his physical attack. Medical evidence corroborated her testimony, documenting extensive injuries including swelling to her left eye, wrist, and upper left arm, as well as soft tissue trauma and hematomas across her left thigh, upper arm, and right breast. Hamid admitted to scratching Seeram during the ordeal in self-defense before he grabbed a firearm and left the heavily damaged property.

 

In evaluating the evidence, Magistrate Gibbs dismissed Seeram’s assertion that he had merely used a “single push” to leave the residence while framing Hamid as the aggressor. The Magistrate noted key contradictions in his narrative, pointing out that claims alleging Hamid had fallen while intoxicated or self-inflicted her injuries were absent from his original statement to law enforcement.

 

Finding Hamid to be a credible witness whose physical injuries directly matched her testimony, Magistrate Gibbs ruled beyond a reasonable doubt that Seeram had not acted in self-defense and that his physical force far exceeded a simple push to exit.

 

Following the guilty verdict, the Magistrate ordered a probation report, victim impact statement, and written legal submissions ahead of a November 2, 2026 sentencing date. She denied an immediate bail application from defense lead Nigel Hughes, who argued that Seeram’s clean criminal record, consistent court attendance, and executive duties, including weekly presidential briefings, warranted his release on bail.

 

Though Prosecutor Ganesh Hira signaled no opposition to bail subject to weekly reporting, Magistrate Gibbs held firm, determining that statutory criteria under Section 9 of the Bail Act had not been satisfied. Seeram was subsequently detained at the court outpost while the prison transport departed the compound at 1:30 p.m. without him.

 

By late Friday afternoon, Seeram’s defense team, comprising Nigel Hughes, Kiswana Jefford, Tifaine Rutherford, Nadia Gomes, and Jacinta Cave, filed an urgent 18-page Judicial Review application in the High Court under Case File 2026/894-HC-FDA-DEM-CIV. Naming Magistrate Gibbs as the respondent, along with the DPP and the Attorney General as interested parties, the motion contends that the Magistrate erred in law regarding the Bail Act, failed to consider key defense arguments, acted irrationally under Wednesbury unreasonableness principles, and infringed upon Seeram’s constitutional rights under Articles 139 and 144.

 

During an emergency High Court hearing convened at 5:45 p.m. before Justice Persaud-Singh, State Counsel S. Lall indicated no objection to bail pending sentence. However, Justice Persaud-Singh ruled that the High Court required the Magistrate’s formal Memorandum of Reasons and an Affidavit of Defence from the Attorney General before any release order could be evaluated. Consequently, the judge ordered Seeram to remain in custody at the Sparendaam Police Station lockups over the weekend, scheduling the judicial review hearing for Monday, October 5, 2026, at 11:30 a.m.

 

Throughout the afternoon, the convicted official remained unhandcuffed inside the Sparendaam Magistrate’s Court outpost for over five hours, receiving visits from individuals identified as his family members, driver, and associates. Around 5:00 p.m., police officers instructed gathered reporters to clear the area before hurriedly moving an unhandcuffed Seeram into the adjacent police station, where he was subsequently seen receiving additional visits from local social media figures.
