JUSTICE JOY PERSAUD UPHOLDS REMAND OF DANIEL SEERAM

Justice Joy Persaud this morning has upheld the decision of Magistrate Abigail Gibbs to remand Daniel Seeram ahead of his sentencing scheduled for November 2.

 

The ruling came after Justice Persaud denied an application for judicial review filed by Attorney-at-Law Nigel Hughes, who sought pre-sentencing bail for the former regional chairman.

 

Following the decision, Hughes confirmed to members of the media that he will be appealing the matter at the Court of Appeal.

 

In his arguments before the court, Hughes contended that Magistrate Gibbs erred when she relied on Section 9 of the Bail Act. He further argued that the magistrate was wrong to remand Seeram without first reading all requested pre-sentencing reports, including the probation report, victim impact statement, mitigating factors from the defense, and aggravating factors from the prosecution.

 

Seeram was remanded to prison on Friday after being found guilty of assault causing actual bodily harm to his ex-wife, Farzana Hamid. The conviction was handed down by Magistrate Abigail Gibbs at the Sparendaam Magistrate’s Court following a trial stemming from a report filed by Hamid.
