Court Deems Star Witness in Cybercrime Trial ‘Not Credible’

October 30, 2025
Twenty-year-old Daniel DeFreitas was regarded by a city Magistrate as someone who is not credible. The Magistrate was at the time handing a ruling and sentence to photographer Diliza David, who was charged with cybercrime offences, and for which Daniel DeFreitas appeared as his star witness.
“It is just whether I believe him or not, and the witness he brought in support. I find that I disbelieve him, I find them not to be credible,” Magistrate Singh noted.
DeFreitas of Lot 420 East Ruimveldt is a very personal and close friend of now convicted criminal Diliza David, who was found guilty and sentenced to jail on Thursday morning.
To save his friend, Daniel DeFreitas appeared in court during the trial as the star and only witness for David. In his statement, DeFreitas placed himself at a location where he stated Smith inappropriately touched David.
However, under cross-examination, he could not answer basic questions put to him by an attorney. It should also be noted that what Daniel DeFreitas told the court as facts contradicted aspects of a police statement that Diliza had signed.
