High Court sets hearing for Constable Ryan Greene’s bail application in CCTV data controversy

The High Court of Guyana has scheduled an urgent hearing for Tuesday, November 10th, 2026, to determine whether twenty-year-old police constable Ryan Greene will be granted bail following his remand on cybercrime charges.

The fixed date application, filed by his father Randy Greene acting as next friend, names detective cadet officer Stephan Hinds of the Major Crime Investigation Unit as respondent and will be heard in person before Justice Zamilla Ally-Seepaul in court five of the Demerara High Court.

Greene, Constable number 26832 attached to the Guyana Police Force Command Centre at Liliendaal, has been held in custody since his arrest on October 26, 2026.

The legal challenge stems from an October thirtieth appearance at the Sparendaam Magistrate’s Court, where Greene was jointly charged with Opposition Leader Azruddin Mohamed under Section 9 of the Cybercrime Act 2018. The indictment alleges that on October 13, Greene unlawfully obtained closed-circuit television footage from a computer system at the Command Centre depicting an October 12 shooting incident along Barr Street, Kitty, and intentionally transferred the electronic data to Mohamed without lawful excuse. Magistrate Abigail Gibbs refused bail during the initial hearing, endorsing on the case jacket that “remand was necessary due to the serious nature of the offence and expressing concern that Greene might interfere with ongoing investigations.”

In court filings prepared by Attorney-at-Law Darren Wade, Randy Greene asserts that the Magistrate’s refusal of bail was unlawful and misapplied the Bail Act of 2022. The defense emphasizes that the cybercrime offence charged under section nine carries a maximum penalty of five years’ imprisonment on indictment, meaning it does not meet the statutory definition of a “serious offence” under the Bail Act, which requires a potential sentence exceeding five years.

Furthermore, the application argues that no evidence was presented by special prosecutor Darshan Ramdhani KC to support claims that Greene would tamper with evidence or approach witnesses if released, with legal representatives noting that “no evidence was presented to support claims of tampering.”

The affidavit also directly challenges the prosecution’s characterization of the surveillance data as sensitive information relating to national security.

Defense documents highlight that the Safe Country video feed records public thoroughfares like Barr Street, Kitty, for routine crime prevention, with live feeds regularly displayed to the public on large electronic billboards at Stabroek Market, Bourda Market, and the Kingston Seawall Bandstand.

Wade contends that parliamentary debates from July 2018 confirm section 9 was narrowed specifically to prevent prosecuting the exchange of general public surveillance, making the charge legally flawed while Greene remains held at the Camp Street Prison pending the high court’s determination.

Parliamentary records indicate that lawmakers sought to ensure “section 9 was narrowed specifically to prevent prosecuting the exchange of general public surveillance.”
