‘Moon ah run till day katch um’- Bisram’s lawyer as prosecutor spends 1-hr in toilet

MURDER ACCUSED: Marcus Bisram leaving court on Thursday

Magistrate Renita Singh today had cause to question the prosecution on its readiness to proceed with the case against Marcus Bisram after several elementary requirements were not met by the prosecution in order to have the matter proceed when it was called this morning.

When the matter was called the magistrate told the court that she was advised that the prosecution was in the washroom, that washroom visit lasted for approximately one hour, forcing the magistrate to stand the case down. “I don’t know how to put this, but I am advised that the prosecutor is in the washroom’ the magistrate hesitantly stated to the court which resulted in pockets of gimmicks and smiles.

Bisram’s matter is not without its own little drama, featuring recusing, no-shows and non-disclosures all contributing to numerous delays.

When the matter was finally called after the prosecutor made herself available, the prosecution attempted to submit statements to the court as evidence but those statements were not stamped nor were they certified, this caused a further standing down of the matter until the prosecution got that sort out.

“Why are you in such a state of unpreparedness this morning” Magistrate Singh questioned the prosecution.

“Moon ah run till day catch umm,” Datadin told the court. He was at the time seeking to hit home a point continuously made by the defense lawyers for Bisram that ‘the state has no evidence against their client’ The phrase is a West Indian parable which is used to suggest that at some point, anything in the dark will come to light.

Datadin today objected to a move by the state to include as part of its submissions, statements from the five men who were initially charged with the murder of Faiyaz Narinedatt.

Datadin told the court the statements are inadmissible admissible since the five men are his clients who and at no point was he or the men approached and informed or asked that they five would be regarded as part of the prosecution’s case.

“It is not admissible in law, this is the most preposterous thing that happened today, all the statements that we have, they have not been put in order, they have not been indexed, the prosecution has us waiting for more than an hour and half then we had to wait a further hour because they did not have the stamped certified copies” Datadin recalled to the press after the matter was adjourned.

State prosecutor Stacy Goodings told the court that during the testimony of the state’s 17-year-old star witness, the names of the five were mentioned so he feels that it was enough for their statements to be submitted as part of the prosecution’s case.

Datadin also objected to the inclusion of a vehicle registration which he said was not relevant to the cased. Video and photographic evidence submitted today received the defense side’s no objection.

The defense argued that the state has been fighting for years to have Bisram return to Guyana and now that he is here, there continue to be all sorts of delays as every week, the prosecution needs to be given time ‘to fix something’ The matter will be called again on February 27, 2020
